Islam is not above the Federal Constitution, and the decision by the Federal Court on Lina Joy's appeal was not politically motivated, said Prime Minister Datuk Seri Abdullah Ahmad Badawi.
"One must have a hole in the head to say it was a political decision. We've never asked or pressured the court to make political decisions," he said.
"The problem here is emotion, and if one allows emotion to control [him/her], this is what will happen and one will have all kinds of things in the head, including suspicion."
He was asked to comment on allegations that the court's decision was politically motivated.
The three-member panel of judges, in a 2-1 judgment on Wednesday, dismissed Lina's appeal to have the word "Islam" removed from her identity card after she converted to Christianity, without an apostasy certificate from the syariah court.
Abdullah said Islam was not above the Federal Constitution. "This country upholds the Constitution and supremacy of the law, otherwise, we would have become a failed state.
"We must uphold our Constitution and all laws are made in Parliament and by Parliament. That is made of all sorts of members and it is a multiracial Parliament," he said after chairing the Umno Supreme Council meeting.
"Dia-lah yang mengutus rasul-Nya dengan membawa petunjuk dan agama yang benar agar dia memenangkannya di atas segala agama-agama meskipun orang musyrik membenci." As-saff:9
"..dan Al-Quran menjadikan orang-orang kafir Itulah yang rendah. dan kalimat Allah Itulah yang Tinggi. Allah Maha Perkasa lagi Maha Bijaksana." At-Taubah:40
I am a muslim. If there happen to be laws in Islam that can prosecute Lina Joy for leaving Islam, it cannot be practiced since Islam is not supreme in this land.
ReplyDeleteWhen Islam first became law in Madinah, the non-muslim professed to Islam willingly because they saw the beauty in its entirety. When Islam ruled over middle east, the non-muslim communities are subjected to their own laws. If Islam is the constitution in Malaysia, and Islam is truly practiced, non-muslims can choose to embrace Islam or live the way they want with their own laws. But in Malaysia, Islam is only for Bank Islam, kahwin, cerai and (I couldn't think of more). It is the current government who encourages the muslim rakyat to love the western non-muslim style of life so they can remain powerful. In turn, the muslims look no different than the non-muslims so the non-muslims don't appreciate the muslims for being muslims. Respect of other religions? What are the non-muslims to respect about muslims in Malaysia if there is nothing significant they can see to respect? (I don't mean every muslim in Malaysia in these statements).
About Lina Joy, I think we seems to be desperate to have her in our fold. When some muslims left Islam after the Isra' and Mikraj event, there is no historic evidence that they are prosecuted. (Isra' and Mikraj event is an event when the Prophet claimed to travel from Mecca to Jurusalem and meet God in heaven in a single night. Only the most faithful remain muslims after the event). This happen when Islam was still in Mecca, with no power or authority what so ever. Since in Malaysia, Islam is not law just like in Mecca during the Isra' and Mikraj event, I think just let Lina Joy leave Islam. There is nothing we can do.
Just like Mecca then, Malaysia is just a place where muslims live but not an Islamic country.
This is just an opinion. I ask forgiveness from Allah if any I commented above is wrong.
Salam, juz nak jadi nasi tambah, sedap x sedap lain kira ye, pada saya jika nakk biarkan lina joy simply leave the religion...there're certain issues affected, especially politics, social, legal and of course constitution (by which currently partially safeguards Muslim).
